This privacy policy describes how Toy Lark Solutions LLC ("Toy Lark," "we," "us," or "our") collects, uses, and discloses information when you visit toylark.com or interact with our business. By using the site, you agree to the practices described below.

This policy covers information collected through toylark.com. Information we receive from clients in the course of our consulting engagements is governed by the engagement agreement between Toy Lark and the client, not by this policy.

This site is directed to businesses and individuals in the United States. We do not offer services to or target residents of the European Union, the United Kingdom, or other regions outside the United States. If you access the site from outside the United States, your information will be processed in the United States, where privacy protections may differ from those of your home jurisdiction.

Information We Collect

We collect information you provide directly to us and information collected automatically through the site.

Information you provide. When you submit the Connect form on toylark.com/contact, you provide your name, company, email address, an optional phone number, and the message describing how we can help. We also collect any information you include in direct email correspondence with us.

Information collected automatically. The site uses Google Analytics to understand how visitors use the site. Google Analytics may collect your internet protocol (IP) address (subject to Google's IP anonymization defaults), browser type and version, device type, operating system, the pages you view, the time and duration of your visit, the website or source that referred you, and approximate geographic location based on IP address.

Our hosting provider (GoDaddy) maintains server logs that record similar technical information, including IP address, request timestamps, and browser identifiers, for security and operational purposes.

We do not collect sensitive personal information (such as government identifiers, financial account numbers, health information, or biometric data) through the site. If you send sensitive information in a Connect form message, we will handle it with the same care as other information you provide, but please use other channels for transmitting sensitive material when possible.

How We Use Your Information

We use the information we collect to:

  • Respond to inquiries submitted through the Connect form.
  • Follow up on business opportunities and provide consulting services.
  • Understand how visitors use toylark.com and improve the site's content and performance.
  • Protect the site against fraud, abuse, and security incidents.
  • Comply with legal obligations.

We do not use your information for targeted advertising. We do not sell your personal information. We do not share your personal information with third parties for their own marketing purposes.

How We Share Your Information

We share information only as described below.

Service providers. We use third-party service providers that process information on our behalf to operate the site and our business. These include:

  • Google (Google Analytics for site analytics, Site Kit for WordPress integration)
  • GoDaddy (web hosting and email services)

These providers may process your information according to their own privacy policies and our service agreements with them. We select service providers that maintain reasonable security practices.

Legal requirements. We may disclose information if required to do so by law, subpoena, court order, or other legal process, or to protect our rights, property, or safety, or that of others.

Business transfers. If Toy Lark is involved in a merger, acquisition, sale of assets, or similar transaction, your information may be transferred as part of that transaction. We will notify you through this policy if your information becomes subject to a different privacy policy as a result.

Cookies and Analytics

The site uses cookies for two purposes.

Functional cookies. Required for the site to operate, including session state in the WordPress and Breakdance environment.

Analytics cookies. Google Analytics sets cookies to measure site usage. These cookies do not identify you personally to us. Google Analytics may combine the information it collects with information from other sites and services you use; see Google's privacy policy at https://policies.google.com/privacy for details.

You can disable cookies through your browser settings. If you disable cookies, parts of the site may not function as intended.

You can opt out of Google Analytics tracking on this site by installing the Google Analytics Opt-out Browser Add-on at https://tools.google.com/dlpage/gaoptout.

Data Retention

We retain your information only for as long as needed for the purposes described in this policy.

  • Connect form submissions: retained for 36 months from the date of submission, unless you become a client, in which case the information is retained for the duration of our engagement and any applicable record-keeping period thereafter.
  • Direct email correspondence: retained according to our business email practices, generally not longer than 36 months for non-client correspondence.
  • Analytics data: Google Analytics user data is retained for 14 months and reset on new user activity; Google Analytics event data is retained for 2 months.
  • Server logs: retained according to our hosting provider's defaults, typically 30 to 90 days.

We may retain information longer than the periods above when required by applicable tax, legal, or contractual obligations.

You can request deletion of your information earlier (see Your Rights below).

Your Rights

Depending on where you live, you may have rights regarding the information we hold about you. These may include the right to access the information we have, the right to correct inaccurate information, the right to delete your information, and the right to opt out of any sale or sharing of personal information (although we do not sell or share personal information for cross-context behavioral advertising).

To exercise any of these rights, email info@toylarksolutions.com with your request. We will acknowledge receipt of your request within 10 business days and provide a substantive response within 45 calendar days. We may extend the response period by an additional 45 days when reasonably necessary, with notice to you. We may ask you to verify your identity before processing your request, typically by confirming information you previously provided to us.

If we deny your request in whole or in part, you may appeal by emailing info@toylarksolutions.com with "Appeal" in the subject line. We will respond to appeals within 60 days.

You may also have the right to lodge a complaint with your state attorney general or applicable privacy regulator.

California Residents

If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), may give you specific rights regarding your personal information.

Categories of personal information we collect. In the past 12 months, we have collected the following CCPA-defined categories: identifiers (name, email, IP address); commercial information (company name); internet or other electronic network activity information (analytics data); and professional or employment-related information (information you provide about your role or company in the Connect form message).

Sources. We collect this information directly from you (Connect form, email correspondence) and automatically through our website (analytics, server logs).

Business purposes. We use this information for the purposes described in How We Use Your Information above.

Categories of third parties. We disclose personal information to service providers that operate the site and our business (technology vendors including Google and GoDaddy), to government agencies and other parties when required by legal process, and potentially to a successor entity in the event of a merger, acquisition, or sale of assets. We do not disclose personal information to affiliates, advertising networks, data brokers, or marketing partners.

Sale or sharing of personal information. We do not sell your personal information. We do not share your personal information for cross-context behavioral advertising.

Sensitive personal information. We do not knowingly collect sensitive personal information through the site.

Your CCPA rights. California residents have the right to know what personal information we collect, to request a copy of that information, to request correction or deletion, to opt out of sale or sharing (not applicable since we do not sell or share), and to be free from retaliation for exercising these rights. To exercise these rights, email info@toylarksolutions.com. We will acknowledge receipt within 10 business days and provide a substantive response within 45 calendar days, with a possible 45-day extension as described in Your Rights above. We will verify your identity before processing your request.

You may also authorize an agent to act on your behalf. Acceptable documentation includes a signed written permission from you, a notarized power of attorney, or a copy of the agent's business registration filed with the California Secretary of State if the agent is acting in a professional capacity.

Other State Privacy Rights

Residents of US states with consumer privacy laws, including Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Delaware, New Jersey, Tennessee, Iowa, Indiana, Kentucky, Rhode Island, Minnesota, Maryland, Nebraska, and New Hampshire, may have rights similar to those described under Your Rights and California Residents above. These typically include the right to access, correct, delete, and obtain a copy of your personal information, and the right to opt out of targeted advertising, the sale of personal information, or certain profiling activities.

We do not sell personal information, do not engage in targeted advertising, and do not conduct profiling that produces legal or similarly significant effects.

Security

We maintain administrative, technical, and physical safeguards designed to protect the information we collect against unauthorized access, alteration, disclosure, or destruction. These safeguards include access controls on our systems, encryption of data in transit (HTTPS), and selection of service providers that maintain their own reasonable security practices.

No method of transmission over the internet or method of electronic storage is 100% secure. We cannot guarantee absolute security.

If we become aware of a breach affecting your private information, we will notify affected New York residents and the New York Attorney General as required by the New York Stop Hacks and Improve Electronic Data Security (SHIELD) Act, and we will notify residents of other states according to applicable state breach notification laws.

Children's Privacy

The site is not directed to children under 16. We do not knowingly collect personal information from children under 16. If you believe we have collected information from a child under 16, contact us at info@toylarksolutions.com and we will delete it.

Links to Third-Party Sites

The site contains links to third-party websites and services, including LinkedIn and X (formerly Twitter). We are not responsible for the privacy practices of these third parties. Their privacy policies, not this one, govern your interactions with them.

Do Not Track

Some browsers transmit "do not track" (DNT) signals. Because there is no industry standard for honoring DNT signals, we do not currently respond to them. We do not engage in cross-site tracking that would benefit from a DNT response.

Changes to This Policy

We may update this policy from time to time. When we do, we will revise the "Effective" date at the top of the policy. Material changes will be highlighted on the site or communicated to you directly when reasonable. Continued use of the site after changes constitutes acceptance of the updated policy.
